The judicial system of the Republic of Belarus
Judicial power in Belarus belongs only to the courts established in accordance with the established procedure, and is independent from the legislative and Executive branches.
The courts upheld guaranteed by the Constitution of the Republic of Belarus and legislative acts of the Republic of Belarus:
personal rights and freedoms;
socio-economic and political rights of citizens;
the constitutional order of the Republic of Belarus;
the state and public interests;
law legal entities irrespective of patterns of ownership, departmental subordination and economic conditions.
The right to seek judicial protection guaranteed by article 60 of the Constitution of the Republic of Belarus.
The court system
The system of courts is based on the principles of territoriality and specialization. It consists of:
The Constitutional Court;
The system of courts of General jurisdiction.
The establishment of extraordinary courts is prohibited.
The judicial system in the Republic of Belarus is determined by:
The law of the Republic of Belarus of 8 January 2014 "On the constitutional proceedings";
Code of the Republic of Belarus on judicial system and status of judges.
The system of courts of General jurisdiction
The system of courts of General jurisdiction consists of:
The Supreme Court Of The Republic Of Belarus;
regional (Minsk city) courts;
economic courts of areas (city of Minsk);
district (city) courts.
The Supreme Court of the Republic of Belarus carries out justice and supervision of the judicial activity of the General courts.
It consists of:
The President of the court;
first Deputy Chairman;
Vice-presidents;
judges of the Supreme Court of the Republic of Belarus
and consists
judicial Board on civil cases of the Supreme Court of the Republic of Belarus;
judicial Board on criminal cases of the Supreme Court of the Republic of Belarus;
judicial Board on economic cases;
judicial Board on Affairs of intellectual property of the Supreme Court of the Republic of Belarus;
The Presidium Of The Supreme Court Of The Republic Of Belarus;
The Plenum Of The Supreme Court Of The Republic Of Belarus.
The courts under the General jurisdiction of criminal cases and civil cases.
The number of civil cases include:
cases on the disputes arising from the relations:
civil;
family;
labor;
housing;
land;
relations on use of natural resources and the environment, if at least one of the parties to the dispute is a citizen;
cases arising from administrative legal relations;
cases of special proceedings;
other cases which fall within jurisdiction of General courts Civil procedure code of the Republic of Belarus and other legislative acts.
